If the case doesn't have merit, it's likely that no action would be brought. The body of law regarding copyright licenses is very small - virtually all copyright case law focuses on if a copyright could be established in the first place, and if a work is derivative of another, not on the technical aspects of a license of rights. I suspect that is so because the combination of common law, standard contract law, and the explicit text of Title 17 does a pretty good job of handling all the basic infrastructure.
