I'm not sure I'm following what you are asking.  And I
have no intention on getting into another theoretical
discussion about an issue that has been thoroughly
hashed out on this list well over a dozen times.

Put as simply as I can:

OGC must be clearly identified in a way that makes all
OGC clearly identifiable as OGC when it is being
looked at by a person.  After a person has read the
OGC designation they should immediately know when they
are seeing OGC and when they are not.  Any method of
designating OGC that requires constant and regular
reference to an outside source or location will likely
fail the reasonable person test that any court will be
applying in a dispute.
