Nintendo sued Camerica over the GameGenie for creating a derivative work and violated Nintendo's copyright when it altered the code between the cartridge ROM and the console game. Though the suit was ultimately lost, major questions remain as to what constitutes a derivative work. The FSF says that in-memory derivative works ought to count for copyright purposes, and be the sole right of the copyright owner.
