[Winona Online Democracy]

The reason searches are legal is because the school is acting as the parent.
The legal term is locos parentis. A parent does not need a search warrant
to search a child's belongings and when they send their child to school they
are extending their parental rights to the school. School officials have
the right to search and seize, but a judge would have to decide whether
anything was useable as evidence. The primary concern of the school
official is not for evidence, but for the safety of the school environment.
When kids don't feel safe they don't learn well.
