I have a listing of the IBM EGA BIOS so I might be able to help on the
listing side of a "Chinese Wall".  Or, do you think that IBM cares
anymore since they got out of the PC business.  Actually, the assembler
code would be modified so much for our hardware that it wouldn't be
recognizable.  I presume that, as in music or literature, you are
allowed to copy a little.

IANAL, but, from what I believe, if the work is not a direct copy (ie:
it was created
independently*) then there is no problems, even if things end up
"looking" similar.

So in this case, taking the code and modifying it (even if it was
completely different)
would be violation of copyright, unless there were provisions made for
something like
that (eg: GPL licence, etc).

Additionally, there may be patents involved which complicate things
further. This is
because the ideas themselves are "property" and generally treated as
inviolable by
the state/jurisdiction.
