I do not see the point for the community in changing licenses to accommodate NDA's since the resultant code contributions for the material in the NDA are not made publicly accessible. Sure at some point the NDA might be waved and the code might be made public but the idea is to be current and relevant. At best asking to change licenses to suite these private interests is asking for a substantial shift in the hope that these parties *might* *someday* reciprocate. That seems kind of bogus to me.
If OpenOCD is appealing to these companies then it actually presents some pressure on them to change their policy regarding Intellectual Property and associated NDA's. My hope is that eventually the attraction of open tools motivates NDA's to go extinct for this sort of information.
