This topic came up at OSCON, so perhaps that's where you heard the rumblings coming from. Both Jonathan and Simon are admitted fans of the draft GPLv3, and Sun has used GPL before (see OpenSPARC). Even so, the license can't be changed until all the encumbered code is out, and that will take quite awhile (still). I can also tell you, there is also a huge BSD following within Sun, myself included, who will insist that whatever license they choose beyond CDDL not exclude the BSD community from sharing code. In particular, I see a lot of value in sharing platform and driver code between the BSD and OpenSolaris communities, since we don't enjoy the defacto support from vendors that some other, eh, competing systems get. ;)
