There are two names and distro's : openSUSE and Novell SUSE. Indeed some programs will not be included in openSUSE due to licencing. Others will not be available in the Novell SUSE version. All this is still in the making. At this moment I think we are in the process of forming the openSUSE comunity and SUSE and openSUSE will be almost identical.
