Getting back to the core (this is also reproducable under Debian back to 2.6.32): Your patch and the changes in kernel 3.5 which they're based on fix the reboot but it's still a heavy DoS against the Box (Alix). Smashing 70 mbit with 64 byte packets against using pktgen makes the loadavg go above 50 and the system unresponsive while "under attack".. Better than reboot but not good..
