Then they should take that out of the licence. Nicolas has a great point, it is one thing to fear Micorsoft, and it is another to behave like them. Except the office format is actually open, the C# spec is ecma, the CLI is open, you can read windows binaries with their tools... Actually I don't know a single other format or platform you aren't allowed to read -- well I guess the FLA as well : ). Frankly I doubt you could even write a meaningful swf generation app without reading swfs at some point, if just for testing and verification. So really you are required to break the licence to make anything of any significance, making the open spec is more 'open unless you do something (anything) we have a problem with'. People should at least call them on it every time they mention open and swf in the same sentence.
