ITALY: FIVE TUNISIANS ACQUITTED OF TERROR CHARGES
        

Milan, 9 May (AKI) - A Milan court on Monday cleared five Tunisians
accused of helping planning terrorist attacks outside Italy and of
recruiting militant foreign fighters. Four of the five men were
convicted of lesser charges, including criminal association, forging
documents and facilitating illegal immigration, and sentenced to
between 2 and a half and four and a half years in prison. All four
convicted men will be expelled from Italy as soon as they have served
their jail sentences.

The court handed down jail terms of four years and six months to
Abdelhakim Ben Said Cherif, Nassim Saadi and Fadhal Saadi. Ben Haifa
Ben Ahmed Rouine Lazher got a two-and-a-half-year prison sentence,
while Hamadi Ben Abdlaziz Buyahia was cleared of all charges against
him and the court ordered his immediate release. "I hope this sentence
will atone for the unjust suffering caused by preventative custody,"
Antonio Nebuloni, the lawyer who defended Buyahia was quoted saying.

The charge of "subversive association aimed at international
terrorism" was introduced in legislation the Italian government rushed
through after the September 11, 2001 attacks on the United States. "In
this case, the actions on trial were minor and the sentences are
appropriately modest," said Nebuloni. "Terrorism cannot be combatted
by a law that was passed in five minutes," he added. So far, not a
single suspect has been convicted under the new Italian anti-terror
legislation.

Based on phone-taps, and the testimonies of three fellow Tunisians who
collaborated with magistrates, prosecutors alleged the defendants were
members of Ansar al-Islam, a fiercely anti-American group based in the
Kurdish region of northern Iraq. The group is believed to have links
to Osama bin Landen's al-Qaeda network. The five Tunisian suspects
were charged with providing Ansar al-Islam with fresh recruits for a
training camp in Afghanistan, false documents and logistical support,
as well as facilitating illegal immigration.

The lawer for the alleged leader of the five Tunisians, Sandro
Clementi, said the suspects had denied the charges of international
terrorism. The evidence only showed that the suspects harboured
anti-American and anti-Italian sentiment; there was not enough
evidence to prove the terrorism allegation, Clementi said.
