Sue,
Unfortunately your question is not a simple one to
answer. You need to look at the NJ practice act to determine what your
state laws are regarding physician referrals. If you are a direct access
state, you may not necessarily require an MD order. That being said,
payers are few and far between who will reimburse for services that are not
ordered by a physician.
The second part is whether you are required to obtain and
maintain MD certification of your treatment plan. Your medicare patients
can't be treated without this certification and recertification every 30
days. What you need to do is familiarize yourself with state statute and
payer guidelines for your primary payers.
A great resource for regulations related to OT is AOTA.
Another that I continue to find very useful is PTManager.com.
Good Luck

I am in NJ. As an outreach service provider, there seems to be a difference of opinion among the OTs as to which settings an OT can provide services without a dr's. order. (ex: school, day workshops, etc. ) I don't want anyone putting their licence in jeopardy, and I can't seem to get a definitive answer ( in writing) from anywhere. Any direction would be greatly appreciated.
