I'd say a big reason why people do not help to seed files that they downloaded is because they are worried about being caught for copyright breaches. If your incentive could make people immune to this, or at least mitigate it or make it clear when copyright was not an issue, then you would see a great deal more seeding.
Sure, fixing issues at the legal front is maybe even more important, but if we could devise a way that "could prevent abuse" (TM) and make that clear to the users, seeding would increase also.
