The issue isn't how much money you make or don't make, the issue is that Disney controls distribution of their intellectual property and you haven't gained the necessary permission.
The easiest way around this is to change the character so that it's no longer recognisable as the Disney character. See what your son can come up with as an alternative - - challanging children's imagination can produce some amazing results.
