They *do* have zero length in the archive. They are (hard) links to
previous files in the archive.
You don't say whether extracting the files actually failed, or it's just
that you were surprised by what you saw when listing the archive.
If the former, it is indeed because your tar utility is failing you.
Cygwin's tar copes with these just fine.
