I suggest that you encourage you branch and other branches including other
regions to send submission supporting Johannesburg Region letter demanding
information, this will strengthen the approach and also send a message to
all NEC members to stop taking party structures, branches and members for
granted.

I just wish this letter can be regarded as one unified appeal on behalf of
all regions, Branches and component structures of the PAC. This confused
confusion is discrediting our effort of increase our membership as people on
the ground are rightfully questioning our party standards and programmes.
Yes indeed, we are converted to a historical ceremonial events with no
proper guidance and Programme of Action due to this "Secrecy Bill" (lack of
transparency from NEC & President on POA and stinginess to share minutes
each meeting held by them ; and lack of visible leadership).

I wish this plea from your region to be treated as a loud appeal from all
members, followers and sympathizers of this giant organization, instead of
being regarded as Ntjantjarag region who like to steer unnecessary tension
and searching for attention. 

We all need a coherent report on this matter at hand.

On the 11th May 2013 evening; PAC branches, members and veterans learn
through SABC News that at the National Executive Council meeting held on the
11th May 2013 the "PAC National Executive Council resolved to recall its
President and passed a motion of no confidence". Ever since this occurrence
PAC members, branches and veterans within our respective region(s) required
and demanded an account, we could not provide a succinct explanation due to
lack of information arising from non-communication from Head Office. PAC
members, branches and veterans  have been shocked to learn about internal
matters of the party through SABC News and other media agencies.

On internal party matters as a standard practice also noting the nature of
items deliberated, the decisions and outcomes of the National Executive
Council meeting should be communicate to members and branches in writing as
a matter of priority, to date we have not received any formal communication.
There has been conflicting and contradicting information provided to members
and structures which causes an unnecessary confusion, such as recalling not
implying suspension others claiming recalling based on suspension. One deems
it fit that party members and structures should not be subjected to any form
of speculation nor hear say.

On behalf of PAC branches and members in Johannesburg region, we urge your
office to send us the resolutions, minutes and signed attendance register
explaining as to what transpired on the 11th May 2013 including the status
of the 11th May 2013 meeting. We will be glad if we can receive this
detailed account communication/ correspondence not later than the 15th May
2013 before 16H00, such that we can distribute the information to all Branch
Executive Committees who will dutifully share the contents with their
respective branch members.

Your office and the entire NEC should be cognisant of achievements made to
unify PAC members and barcnhes in Johannesburg Region since September 2013
till to date. As PAC members and barcnhes, we have successfully mobilised
and organised all party members and branches to function as a unified Pan
Africanist Congress of Azania, the success and organisation gains should be
consolidated and maintain since we cannot afford a divided PAC in
Johannesburg region and nationally. Post the regional with a unified PAC in
Johannesburg we intend to expand branches and members targeting the 10%
population around Johannesburg including revival of all PAC component
structures. Thus, its incumbent upon objective leadership of party
structures to act in the best interest of the Pan Africanist Congress of
Azania its path of healing and growth.

Hoping that the urgency  of this matter will receive your undivided
attention

PAC Constitution clause  7.1 states that, the NEC shall, subject to the
supervisory powers of the national congress or conference, be the highest
executive, administrative and disciplinary authority within the PAC. 

Lastly composition of NEC is follows 24 NEC members plus 2 PASMA plus 2
APLAMVA plus 2 PAYCO! plus 3 Provincial Chairpersons (Limpopo, Eastern Cape
& Mpumalanga) plus National Chairperson equals 34. Quorum of 50% makes it to
be 17. 

A properly constituted NEC meeting must consider a disciplinary decision by
the disciplinary committee as prescribed by clause 25.3 which then gives
effect of clause 31.1 stating terms under which an office bearers must be
removed if one is found guilty of contravening the party disciplinary code,
therefore, Clause 25.1 states sanctions and penalties (there is nothing like
vote of no confidence as a sanction nor penalty), clauses 25.2 - 25.4
provides the detailed actions that must be pursued when one has contravened
the disciplinary code or risked the image of the party. Clause 23.1. and
Clause 24 outlines disciplinary rules and procedures. If PAC President as an
office bearer was subjected through this constitutional disciplinary process
and on 11th May 2013 Saturday the NEC considered the decision from the
National Disciplinary Committee then such a decision hold if not then all
that occurred is a circus, that is the NEC's conduct and decision is not
based on the prescripts of the party constitution then the 11th May 2013 NEC
meeting acted ultra vires and contra bonos mores, regrettably in the eyes of
PAC members the same NEC members' gathering held on the 11th May 2013 would
have acted not in the best interests of the PAC, harmed the image of the PAC
seriously endangered the running and integrity of the organisation according
to clause 25.2 of Ga-Matlala congress adopted Constitution. 

The PAC constitution clause 29.1 further states that no office bearer or
official shall have the right to bind the party or party HQ in a hire
purchase contract, or enter into a contract on behalf of the party with any
company or individual except where such a mandate is given. And clause 29.2
states that the party shall repudiate all unauthorised agreements made on
behalf of the party and over and   above that, take a disciplinary action
against such an individuals.

As PAC members in branches we are still awaiting an official correspondence
(communique) that explains and account for the 11th May 2013 occurrence, PAC
internal matters cannot communicated to branches through SABC not E-TV!

These should be very basic administrative matters that should not be
subjected to debate. 

The simple question is how are these acts salvaging the PAC from its current
state of disarray and disorganisation?
