FLASHing for one's personal use is OK by me. FLASHing for sale on eBay is another matter. The present distributor of the FirmTek upgrade for the UltraTek 66 says he will prosecute anyone caught "diverting" this firmware to Promise PC cards. So far, I have not heard of any prosecutions, so his statements amount to empty threats. Still, all it takes is a more-or-less formal complaint to eBay, and you could be banned. I don't think anyone cares about a one-off sale ... just wholesale duplication of cards for sale on eBay. Prime candidates for complaints to "the Bay" would be "diverted" UltraTek 66 and Radeon 7000 cards. Most manufacturers have now installed countermeasures to prevent "diversion". This has allowed them to be much freer in distributing firmware updates, as they can be confident that they're not facilitating such diversion. The FLASHers are now checking for the particular manufacturer and part number of the ROM chip, before the card will be accepted. This, plus some manufacturers have moved the ROM into the LSI chip itself, and have made separate part numbers for Mac and PC versions.
