You are just guessing.
To be certain, you might want to look at the Treaty of Berne, which
was signed in (I believe) 1978, and covers international copyright.
I also might be a good idea to check on the copyright laws of the
country you reside in, as well as the copyright laws of the countries
you do business with.
Any Treaty of Berne signatory country should have fairly similar
copyright laws, provided they are living up to the agreement that
they signed.

As a general guide, whether an image is considered "art" isn't
germaine to copyright law. What is germaine is ownership of the
image.

In Tanja's case, she could take the 1 hour place that copied her work
to task for cutting into her income.
Whether this would be a good move or not depends on individual
circumstances, as sometimes enforcing your rights is not the wisest
thing to do.
