This is a case of criminalizing something that wasn't criminal before,
the law is an exercise in prior restraint written badly, vague and
dependent on knowledge that the enforcers of said law cannot reasonably
have. At the same time giving those same enforcers ample room for
abuse. If I could depend on a judge looking at such a law and saying,
this is clearly unenforceable, or more importantly a prosecutor saying
the same thing, I would agree with you. However that is too seldom the
case, and as has been pointed out, an accusation such as this implies
can ruin someone's, reputation and finances, even if they are exonerated
in the end. The important thing is to let those who see this as a
panacea, know the downside of their support, nothing more.

Everyone demands instant justice as well they should. Nevertheless,
this is the real world of governments made up of humans, not gods.
What earthly good do clichés such as, "Tell that to the photographers
who will be defending themselves in court until that happens..." What
do people hope to accomplish by saying things such as this? What do
YOU hope to accomplish by saying things such as this? Is it some
passive-aggressive objection to my having said what I did? Of what use
is it to hide the truth... from anyone? "Tell that to the
photographers... blah, blah, blah?" Of course I will! What's the
alternative? Lies? Keeping them in ignorance? Better to support them
and encourage them to fight rather than to play some game of "pretend"
with them. Bucking government tyranny takes courage in spite of the
knowing the ugly truths of this world.

Laws passed that restrict such things as photos of subjects in plain
view (regardless of content or purpose) are always eventually struck
down by courts as a restriction of liberty. It may be immediately
(often), it may be a few years (common), a few decades or (in some
rare instances) a century or so. It may even take a reversal by the
court, but it's always eventually done.
