Sorry William, but the owner is responsible , if the dog were being held
legally responsible there would be a trial with the dog as the
defendant. The owner will be held responsible, the dog is simply a
dangerous nuisance being eliminated. Dogs have no legal
responsibilities, the owners do. The dog will suffer for the owner's
lapse however.

actions so they cannot have rights, it's a two edged sword, unless

Animals are regularly held responsible for their actions. Anytime a
dog is put down for biting, it is being held responsible for it's
actions. All aversion training methods are based on the theory that
the animal (dogs mostly with this training) is responsible for his
actions, and that there are consequences as well as rewards, depending
on the behaviour.
The rights this confers on them varies from owner to owner.
