Well I didn't make the original statement I was just giving my take on it. :-)
I don't know how we got to founding documents but it's important to remember 1) that the founding documents of almost every nation, even the 1977 Soviet constitution, propose to guarantee essentially the same common set of basic rights and 2) the documents are pieces of paper which can be interpreted/misinterpreted by those in power, much the way treaties are. The founding documents of the United States have not stopped the travesties of justice that occur here routinely with liberty and the pursuit of happiness.
