Copyright law got "updated" in 1998 to include digital media. That's why it's named the Digital Millennium Copyright Act (DMCA).

The part about the owner of the equipment being financially liable for any infringement was intended to allow Sony et al, and Microsoft et al to go after the plants where bootleg CDs were manufactured; bankrupt them and shut them down. That's why the penalties are so draconian.

As it turns out, those plants are located in places where U.S. Copyright law doesn't count for much - China, Vietnam, India, Pakistan, Indonesia, Malaysia ... almost any third world country. Close 'em down in one and it moves lock, stock & barrel to another.

I don't think they intended to screw the mini-lab operator, that's just an additional unexpected benefit from their point of view.

And they certainly didn't intend a boon to photographers, or they wouldn't have come back with their "Orphan Works" copyright legislation in 2008.
