I think you know the answer... >From what I have read, DMAX 4.0 is the theoretical limit or the calculation scale, not the limit of a particular film. Therefore anything above 4.0 is definately not using the standard scale, or is just made up.
There is no way to tell other than reading reviews and looking at posted scans. The best are on www.imaging-resouce.com, they are pretty exhasutive and address this issue directly with scanned examples.
