As a percentage of those convicted, the wrongly convicted is very very
small, but for those who've lost years of their lives, one can't
imagine the torment. To my mind, one very good argument against the
death penalty (some of those wrongly conviced would have been put to
death were they convicted in a US death penalty state).
I followed the David Milgaard case fairly closely after his mom forced the
Crown to look at the case again. I was pretty appalled by the way the Crown
in the original trial chose to completely ignore evidence in favour of
pasting the crime to Milgaard's forehead.
What is really disgusting about the whole thing is that the guy who
prosecuted him went on the become a cheif justice in Saskatchewan and the
guy who was his boss went on to become premier while the man who they lied
about and cheated out of the best part of his life got to sit in a jail cell
wondering what the hell happened to justice in Canada.
Millgaard got something like 22 years in jail for walking in a back alley a
few blocks from a murder, and the people who lied to put him in jail faced
absolutely no penalties at all for doing it.
I've always wondered why police and prosecuters can go off on these witch
hunts with absolute immunity from penalty when anyone else doing something
similar would face a contempt charge and probably jail time.
