Sounds like driver error to me.

With poor design a contributing factor. The pedals shouldn't have been so close together the drivers couldn't tell the difference, and the transmission shouldn't have been able to be shifted from neutral to drive or reverse with the throttle engaged full on.

But yeah, it's all entirely the driver's fault.
