And even if you win, the jury can decide not to award damages, anyway. This recently happened to some friends of mine. They'd sued a business partner for breach of fiduciary duty. The jury found the partner guilty of breach of fiduciary duty. The jury agreed with the damage analysis presented during the proceedings, which amounted to seven figures US$ of damage. But they still decided to award nothing, no damages and no costs/fees, and chose not to explain why, which they are allowed to do.
