I have to think that this guy is somewhat better off that his photo was stolen than he would have been if the shot had never made it off flickr. He did get paid for one use, and this video is going to make him somewhat well know. If he was already an established photographer and was regularly selling his work, the lifting of the photo would be more of a grievance. It's not right, but it's probably a plus for him.
