Just like the furor over the third-party APIs, a bit of Google searching will provide a much better report than I could manage. They were at one time claiming in their ToS non-exclusive rights to do pretty much whatever they wanted with any photo uploaded to their service, without notice, query, or payment to the owner of the photo. Further, their third-party APIs at one time allowed third-party application developers access to uploaded content in defiance of the privacy settings applied by the owner/uploader of said content, if my memory of the details is accurate.
