Well, no. A copyright violation has taken place whether or not the copyright owner complains, but the guy's not going to get in *trouble* unless they do. Of course, if they tried to take him to court, they can only really claim actual damages, and since the only thing Pentax is losing is downloads from their web site (which are free) and he's only charging 8-9 dollars per disc it probably isn't worth the time :-) Pentax could probably get him booted of eBay but I don't know why they would. He's clearly not doing this for profit; even if he's shipping 1st class mail he's only making 6-7 bucks per disc. Given the time involved, he's probably making about minimum wage.
