Sebelum melakukan operasi STS, beberapa penyedia jasa mengeluarkan Surat Jaminan Ganti Rugi (LOI’s) kepada nakhoda kapal dan meminta mereka menandatangani LOI tsb atas nama pemilik kapal sebelum dimulainya sebuah operasi STS. Berdasarkan beberapa kontak/komunikasi, juga sebagaimana hasil diskusi dg P&I clubs (klub asuransi maritime), prosedur berikut ini direkomendasikan agar di adopsi oleh para pemilik kapal sebagai kebijakan standar. 1) Para nakhoda/managers agar menghindar menandatangani LOI’s yg diberikan penyedia jasa layanan.
2) Bilamana penyedia jasa layanan memaksa, maka P&I club harus segera diberitahu dan berkonsultasi. Adalah penting sekali bagi P&I club untuk diberitahu tentang LOI, jika tidak pemilik kapal tidak dikover asuransinya bila terjadi kecelakaan. 3) Hanya para Nakhoda/Managers yang harus menandatangani LOI, dengan mempetimbangkan saran2 dan masukan dari P&I club. Para managera harus mampu menunjukkan bukti, seperti komunikasi email dg penyedia jasa layanan STS yang mendukung alasan penolakannya menandatangani LOI’s tsb, berdasarkan Step 1 diatas barang bukti ini adalah sangat penting bagi P&I clubs. Tentu saja, penandatangan LOI tanpa melalui konsultasi sebelumnya dg P&I clubnya dapat menimbulkan konflik (masalah) terhadap jaminan asuransi mereka. Lebih2 lagi, dalam beberapa LOI’s, point2 kontrak yang berkenaan dengan gantirugi pihak ketiga juga dimasukkan, yang mana hal tersebut diluar scope tanggungan P&I, sebagaimana yang telah di setujui bersama dg pemilik kapal. Penyedia jasa layanan STS dapat dikenakan pertanggungan sebagian dg syarat pemilik kapal menunjukkan bukti bahwa kecelakaan yg terjadi disebabkan oleh kelalaian fatal dilakukan oleh orang yg bertanggung jawab penyedia jasa Dalam hal ini pemilik dibebani tanggungan atas bukti. We don't see any comment nor response to the same. Only when somebody posting a less important topics then our fellow seafarers quickly responding to the same one after another and sadly some responded in negative ways, I.e. full of hatred, prejudice, under estimating others, showing of selfmight, boasting etc. In order for us to promote Indonesian Seafarers in international market as well as to gain respect from our competitors, foreign seafarers, I think our seafarers should empower themselves with not only seamenship knowledges but also with gentle behaviour as an respectable officer.
