This is the first version of the focal theory of the law developed by Basu in his book Beyond the Invisible Hand. Interesting distinction between law and norms and critique of the understanding of the law as something that changes the payoff matrix in a game theoretic situation, which even passes as a radical understanding as it takes the morality of out of the situation and turns the criminal into any other rational calculating actor.
