Their kernel code is all in a module, and Linux has stated he doesn't consider modules to be part of the kernel as far as the GPL goes (this being in order to allow binary modules). This also applies for the vmware modules. Their source code is availiable so they can compile on different kernels, but it has an "All Rights Reserved" copyright notice at the top of each file, and I assume is therefore under the same license as the rest of their product.
