Adding restrictions to something given without the restrictions in the
first place isn't also right. Although the intent is letting the CDs
be freely redistributed, adding explicit restrictions forbidding sale
somehow goes against the precept that people can do anything with the
CDs. We really can't add terms to something we didn't even build,
realistically or otherwise.
