The 365kbps is a lie. FLAC is lossless, it takes as much or as little bit rate to represent it as necessary. You can throw more cpu at the task to compress a little better, but you absolutely cannot achieve any particular target bit rate. I saw something (linked off get-iplayer mailing list probably) from the BBC saying they're seeing averages around 500kbps but there are peaks up to 1000kbps. This doesn't surprise me at all based on what my CDs rip to as FLAC.
