It's not about legal alone. Apple reserves a right to ban any App from the App Store without a reason. They did not approve the latest release of the German "Bild" App, for example, because they had some strip show feature. (for all non-Germans: "Bild" is Germany's bigget newspaper, a tabloid).
If a music publisher calls Apple and cries foul, they don't argue, they throw it out.
