Well, it's just how iPeng behaves. Could you file a ticket for this, it might be worth changing although it will be difficult. All menus in iPeng (including NowPlaying) are part of a menu stack and I'd have to extract the menu from the stack. It's possible, I'm doing it in other places, too, but needs tweaking.
