It's rule 9.3 of Apple's App Store review rules. Apps will be rejected
if they use more than 5MB over 5 min for Audio streaming over cellular.

Are you definitely sure Spotify doesn't throttle bitrates over 3G? I
mean: you can always hope to not get caught but once you are there is
no sense in discussing (as a developer).

You'll have to complain to Apple, maybe it eventually helps.

About the operator: you are right: there have been rumors that this was
introduced for AT&T.
But working a lot on mobile comms stuff in my daytime job I now
bitrates For streaming ARE a big issue for operators in Europe, too.
You would be surprised how much the available bandwidth goes down if a
few people stream at high rates. And with the current popularity of
smartphones and MyFi routers lack of bandwidth is increasingly becoming
an issue in urban areas, I've been experiencing it myself. LTE will help
a bit but won't do so for ever. Expect tariffs to actually rise over
time.
