David,

Firstly, you provided the precedent yourself for discussing the
"5300ce special" on LEM lists by posting the advertisement to the LEM
lists... An advertisement in a public forum cannot reasonably expect
to remain undiscussed in a public forum. So comments to the list
about these PowerBooks are perfectly reasonable and legitimate,
especially when dealing with technical support issues (I don't need to
remind you that these lists serve as a public forum for technical
support by the user community).

Secondly, where is the slander (don't you mean libel?) to which you
refer? Libel requires a statement of fallacy or an intentional
misstatement of fact, neither of which occured. Peter simply detailed
issues he found with his PowerBook 5300ce, none of which implicate you
or your business in a way that would imply libel. Additionally, for
Peter's messages to constitute libel in their current text in any way
(noting that you or your business is never mentioned), you would have
to dispute his claims that there are issues with his PowerBook... You
have not done this. In fact, you stated that "the truly unfortunate
thing is that despite our best attempts, not every machine arrives
perfect." (As an aside, in my situation, this does not explain how a
190 Series case bottom appeared on the 5300ce... - I'm not making
gripes, though, as the only difference between 5300 Series and 190
Series case bottoms is the label.)

FWIW, I have also had some difficulties with my 5300ce as well (though
nothing I would consider demands additional service or replacement),
and as this list is intended to provide community responses to support
issues, this is a perfectly fine place to raise the issue. Were my
difficulties requiring attention beyond my abilities, I surely would
have posted my comments to the list (notably, I am already suffering
from intermittent contact between the logic board and power connector
- a well-known issue which I can repair myself - after only 10 hours
of use at most).

However, I suspect these posts will result in unhappy responses from
the list nannies, so if you would like to continue the discussion
further, please feel free to contact me off list.

Peace out,
Drew

P.S. - Before I get flamed, please note that while I am slightly
unhappy with my purchase, I have not accused anyone of wrongdoing.
