Witnessing the defiance of Saddam Hussein on TV during the first 
trial for his alleged 'sin' towards humanity, the article in the 
following in the Hindustan Times newspapare might give some clues why 
this show of defiance was there. At the same time, a question is 
raised that to what extend does the state have the legitimacy to put 
coercive approach towards its subject. 

A quote from the article: 

...that Saddam had no option but to be a brutal ruler. It meant that 
only brutal men like Saddam, who did not shrink from using excessive 
force, could rise to the top in Iraq. In short, Saddam did not create 
his Iraq; Iraq created Saddam.

It's anyone's guess that different yardsticks are used to justify 
this approach.
