Has anyone investigated the ability to have a verbal authorization that
would then be followed up with a written authorization?  

For example, if a disease management vendor (under the marketing
communication mandates) contacts a plan enrollee about joining a specific
program, can they first obtain a verbal authorization to use PHI for the
purposes of their program.  Then, the disease management vendor would begin
their operations while at the same time sending the plan enrollee a written
authorization to send back.

For this specific health plan / employer, the operations of the disease
management vendor would not necessarily fall under health care operations.
The concern is that after contacting the plan enrollee  (under the marketing
communication mandates) about joining the program, that interest may be lost
if they have to obtain a written authorization before moving forward.  It
has been their experience that a verbal contact initially is the most
effective.

Any thoughts?  Similar situations?
