I don't have experience working directly in the ER, but can tell you that while I was recently reading through the new proposed rule (March 27,2002), 45 CFR 160 and 164 part II, there is a section that addresses such comments specifically pertaining to ER releases. I'm not sure if this will help or cause confusion but might be a place to start.
