One of our mental health providers called me this morning to find out what to do about a situation.......
A number of our patients on Serzone have recently received letters from a couple of law firms regarding their medication.  (the FDA put a "black box" warning out regarding Serzone and it's effects on the liver I believe last year)  First of all, the letters are clearly targeted at those patients on Serzone, not the population in general..... we do not give out or sell patient names either from our physician practice or our pharmacy......  we have noticed a common pattern of both who the patients are insured by and by the pharmacies that they are getting their prescription filled...... though we have no solid proof.  The mental health physician questioned whether this was a reportable incident..... I would think so.  But who should report..... the patient or us (the provider).  Are pharmacies considered "covered entities"..... we are considering ours one since they are owned/operated out of our joint clinic/hospital ownership...... but what about the national chain type pharmacies?  Would filing a complaint have any leverage if they are not considered covered entities?
