The issues with this are only in the interface between Windows and the *nix world. The system that Windows has works perfectly in that arena - I have never encountered an issue with non-case-sensitivity in Windows file names, and I've never heard of a regular Windows user bemoaning the fact, or the fact that filename case might not be preserved when creating files. And the Windows search ignores case. This is how Windows works, and people are not clamouring for change as far as I can see. If that doesn't suit how *nix likes to handle files, well as they say in Russia - toughski.
