manufacturer applies to their device as it is produced. It's kind of "burned" into the device hardware BIOS code. (Although most devices of that type will allow for MAC spoofing where you can tell the device what MAC address to respond with. But you can't have two devices, with the same MAC, connected to the same cable drop...won't work.)

How the manufacturers keep from having duplicates is, as far as I know, due to the length and randomness of the number...or maybe they're assigned number ranges. I dunno.
