Breaking up the code something like this works:
nTa = 0
tlist = ""
DO CASE
CASE nTa > 0 AND NOT EMPTY(tlist)
IF NOT INLIST(nTa,&tlist)
* do something
ELSE
* do something else
ENDIF
ENDCASE
