I don't blame them, but I can see next door neighbors being arrested for
using their neighbors wireless connection..

Common sense would tell me that the limit needs to be whatever the range of
the signal is, not fixed boundaries such as a wall.

I'll guess that he wasn't arrested because the police WiFi squad was 
running around with antennas looking for violators, but because the 
Cafe complained that he was using their bandwidth without buying 
something from them. If it was a complaint from Cafe management, you 
really can't blame government for this.
