Well I believe turning the records over falls under the Patriot Act as this is a national security issue. These bots can be used to target any domain, including military domains. Just targeting the major players like AOL will take care a major chunk of the infected machines.
Secondly, this IS crime. Some of these major offenders are foreign Russian mobsters.
