Well I believe turning the records over falls under
the Patriot Act as this is a national security issue. 
These bots can be used to target any domain, including
military domains.  Just targeting the major players
like AOL will take care a major chunk of the infected
machines.

Secondly, this IS crime.  Some of these major
offenders are foreign Russian mobsters.

The FBI uses the same contractors that write highly
sophisticated military software, so capability is not
an issue.
