Pretty much.  They had a choice - guilty until proven innocent, which 
means that when the law screwed up, it would be likely that innocent 
people where punished, or innocent until proven guilty, which means that 
when the law screwed up, a guilty person could go free.

They choose to err on the side of letting some guilty go free, instead 
of imprisoning the innocent.
