[Government]  Childers Decision on Hold

"Accusations of a Sunshine Law violation have delayed a decision 
regarding the appeal of a former Sarasota police officer involved in a 
scandal last year.

Chris Childers was fired by City Manager Robert Bartolotta last year 
after videotape of the officer kicking prisoner Juan Perez at the doors 
of the Sarasota Police Department whipped up a public outcry.

On Tuesday, the Civil Services Board in Sarasota heard an appeal. The 
board voted 2-1 Tuesday to drop two of the charges leveled against 
Childers by the City, including a charge of excessive use of force, but 
voted to uphold a charge that he failed to keep his prisoner is proper 
custody.

But that vote came only after concerns were made about board members 
communicating outside the public meeting. Board member Dan Major was 
forced to recuse himself for a statement to board member Fredric Bigio 
which indicated he may have thought Childers innocent before evidence 
was presented. Bigio still voted on the decision.

The board was set to meet Thursday and hear further evidence, then vote 
on possibly reducing Childers' punishment. However, Citizens for 
Sunshine on Thursday asked a judge for an injunction on the hearing, and 
a decision on Childers was put off indefinitely.

City attorneys on Thursday asked that Bigio be recused as well, and that 
a new board be seated to hear the case. Because the city position is so 
similar to Citizens for Sunshine's position, City Attorney Robert 
Fournier said the city is not contesting the group's actions."

Anything but have the courage to confront the issue! I say the guy 
should draw the few months dismissal which he has already served but 
they should hire him back now as a rookie if he gets some additional 
training, which I am sure he would agree to do.

The prisoner was crazy drunk and had soiled himself with vomit, urine 
and feces. In addition to that he was covered with blood from (probably) 
self-inflicted wounds. In spite of all this he was still trying to 
escape. The "kicks" were more like nudges, all it took to knock the guy 
over from an all-fours position in his totaled condition. Yes, Childers 
should have put on gloves and used his hands but in writing reports you 
always should use pen instead of pencil. Big whoop.

Give the man a break! He will never get another job in this economy! End 
his career at 20 something?
