And I wasn't the only one that tried to get a hold of the developer and he never replied to them. Didn't reply to bug reports since 2005. The guy simply uped and left.

That is true as well. But that always doesn't fit into the big scheme of things. A well established project that just simply dies for no reason should not have to fork simply because the owner died on the project.
